This is an off site online only auction ending via soft close on Thursday Sept 19th 2024 @ 6:15pm. 

10% Buyers Premium will apply to all lots sold. 13% buyers premium will apply with credit card purchases.  All items sell as is where is with no warranties or guarantees of any kind. See and fully understand terms & conditions before bidding on any items. All items are to be paid in full and picked up by 6:00pm Saturday September 21, 2024. Payments are to be made via cash, cashiers check, wire transfer, or credit card. 13% buyers premium will apply to invoices being paid with a credit card. 

This Auction is NOT on our yard in Canton. This auction is OFF SITE.

2 Day Only Auction Pickup.

Auction Pickup: Friday Sept 20, 2024 1:00pm - 6:00pm / Saturday Sept 21, 2024 9:00am - 6:00pm. We will have a loader tractor on site until 6:00pm Saturday September 21. We will not have a loader tractor on site after this time. Buyer is responsible for pickup and removal of all auction items. We do not have to ability to take items back to our yard and store them for you. You must pick up at the auction location.

Long Shot Auctioneers - Terms & Conditions

 

PLEASE NOTE:
All bidders at Long Shot Auctioneers (“Auctioneer”) acknowledge that they have read, understand, and agree to be bound by these Terms and Conditions of Sale.

 

General Conditions

All items are sold AS IS, WHERE IS, with all faults, and without warranties or guarantees of any kind, whether expressed or implied. Items may be used, may contain defects, and may be missing parts. Descriptions, photographs, titles, and condition statements are believed to be accurate but are not guaranteed and are provided as a guide only.

Buyers are solely responsible for inspecting items prior to bidding or arranging for an inspection on their behalf. No allowance, adjustment, or rescission of sale will be made due to errors, omissions, or imperfections not noted.

Auction listings are subject to prior sale or withdrawal.

Price Protection & Reserves

Sellers may request a reserve price on certain items, subject to approval by the Auctioneer. A reserve price is the minimum amount the seller is willing to accept for an item. Items with reserves will not sell unless the reserve is met or waived by the seller. Unless specifically advertised as an absolute auction, all auctions shall be considered with reserve.

Sellers may participate in bidding on their own items up to their reserve amount solely for the purpose of protecting an approved reserve price and not for the purpose of artificially inflating bidding or misleading other bidders. This practice is permitted by law and consistent with industry standards.

Auction company employees reserve the right to bid on and purchase items. The Auctioneer may also place bids on behalf of approved bidders at their request when the bidder is unable to bid themselves due to technical issues, time constraints, or lack of internet access.

Identification & Registration

All bidders must register and obtain a bidder number prior to bidding.

  • Online bidders must provide full name, address, phone number, and valid credit or debit card information.
  • Live bidders must provide valid government-issued photo identification.

The Auctioneer reserves the right to refuse registration or bidding privileges at its sole discretion.

 

Payment Terms

All purchases must be paid in full at the conclusion of the auction or immediately upon receipt of invoice.

Accepted forms of payment include:

  • Cash
  • Wire transfer
  • Personal check
  • Company check
  • Cashier’s check
  • Money order

Credit and debit cards may be accepted on invoices totaling under $10,000.

The Auctioneer reserves the right to:

  • Hold merchandise until funds clear
  • Refuse any check
  • Charge a $50 service fee for returned checks

By registering to bid, the bidder expressly authorizes Long Shot Auctioneers to charge the credit or debit card on file for all amounts due, including the hammer price, buyer’s premium, taxes, shipping, handling, storage, administrative fees, and any other charges permitted under these Terms & Conditions.

 

Sales Tax

Applicable sales tax will be added to the final sale price and buyer’s premium (if applicable), unless the buyer provides a valid resale certificate or Ag/Timber number at the time of registration or checkout.

Buyer’s Premium

A buyer’s premium will be added to the final bid price of all items sold.

  • Online purchases: A 10% buyer’s premium will be added to the final bid price.
  • In-person purchases: A 7% buyer’s premium, capped at $2,000 per item, will be added to the final bid price.

Buyer’s premium applies regardless of payment method and is due at the time of settlement. Buyer’s premium amounts are non-refundable.

Buyer Default / Non-Payment

Failure to make payment in accordance with these Terms & Conditions constitutes a default.

In the event of default, Auctioneer may, at its sole discretion, cancel the sale, retain any deposits, resell the item with or without notice, and pursue the buyer for any deficiency, storage costs, administrative fees, damages, and reasonable attorneys’ fees incurred as a result of the default.

Technology & Online Bidding Disclaimer

The Auctioneer is not responsible for technical issues, platform malfunctions, internet connectivity failures, or other technology-related problems that may affect online bidding.

Bidders are solely responsible for ensuring reliable internet access and understanding how to place bids prior to participating in an auction.

 

Risk of Loss & Insurance

Risk of loss, damage, theft, or destruction transfers to the buyer immediately upon the auctioneer’s declaration of sale (the fall of the hammer), regardless of payment status or removal.

Sellers are responsible for maintaining insurance coverage on consigned items until sold. Buyers are solely responsible for insuring purchased items after the time of sale.

Long Shot Auctioneers assumes no responsibility for loss or damage caused by theft, fire, accident, weather, or natural disaster at any time.

All sellers and buyers agree to indemnify and hold harmless Long Shot Auctioneers, its agents, and representatives from any claims, losses, or liabilities arising from or related to the purchase, storage, or removal of items.

Removal & Pickup

Removal, pickup, loading, transportation, and delivery are at the sole expense, liability, and risk of the buyer.

  • Items may only be removed upon presentation of a paid invoice
  • Third-party pickups must present a copy of the paid invoice
  • No items may be removed without approval from Auctioneer staff

Items not removed within the posted removal period may be considered in default and may be stored, removed, or resold by the Auctioneer at the buyer’s expense and risk, without liability to the Auctioneer.

Claims & Returns

All sales are final. Every item sells as is - where is with no warranties or guarantees of any kind. There will be no returns or refunds for any reason. No claims or adjustments will be allowed after items are removed from the premises.

Personal & Property Risk

All persons attending exhibitions, auctions, or removal of goods assume all risks of damage or loss to person or property and release the Auctioneer, its agents, and assigns from liability.

Neither the Auctioneer nor its principals shall be liable for defects or conditions of the premises where the auction is held.

Records

The auctioneer’s and clerk’s records shall be deemed final in the event of any dispute.

Force Majeure

The Auctioneer shall not be liable for delays, interruptions, or failure to perform due to events beyond its reasonable control, including but not limited to acts of God, weather conditions, power outages, internet disruptions, governmental actions, or other unforeseen circumstances.

Limitation of Liability

In no event shall Long Shot Auctioneers be liable for incidental, consequential, or indirect damages, including but not limited to loss of profits, loss of business, or business interruption

 

Governing Law & Venue

This Agreement shall be governed by the laws of the State of Texas. Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction in Van Zandt County, Texas.

If the Auctioneer is the prevailing party in any enforcement action, it shall be entitled to recover reasonable attorneys’ fees and costs.

TITLES & VEHICLE DOCUMENTATION

For items requiring a certificate of title or ownership documentation, including but not limited to motor vehicles, trailers, and other titled equipment, the presence or absence of a title will be disclosed in the auction listing when applicable.

Buyer Protection

For all items requiring a title, Long Shot Auctioneers shall provide the buyer with a valid and transferable title, when required by law, upon completion of payment and all required documentation.

Seller Requirements

Sellers of titled items are required to deliver to Long Shot Auctioneers a valid, transferable title prior to or immediately following the sale, unless otherwise disclosed and agreed to in writing.

Auction proceeds for titled items shall not be released to the seller until a valid title is received and verified by Long Shot Auctioneers.

Delays & Limitations

Long Shot Auctioneers shall not be responsible for delays in title transfer or settlement caused by missing, incorrect, incomplete, or delayed documentation. Buyers will be notified of any known title-related delays.

Buyers are responsible for verifying registration, inspection, licensing, and use requirements applicable in their state or jurisdiction.

 

BUYER COMPLIANCE RESPONSIBILITY

Buyers are solely responsible for ensuring that purchased items comply with all applicable federal, state, and local laws and regulations, including but not limited to registration, licensing, inspection, emissions, safety, transportation, and use requirements.

 

HOURS, MILEAGE & USAGE DISCLOSURE

Any hours, mileage, or usage readings displayed on equipment, vehicles, or titled items are provided as shown and are not guaranteed. Such readings are believed to be accurate but may not reflect actual use.

 

PHOTOGRAPHS & VISUAL REPRESENTATIONS

Photographs, videos, and other visual representations are provided for convenience only and may not depict all conditions, defects, or characteristics of an item. Buyers are responsible for reviewing item descriptions and conducting inspections prior to bidding.

 

ERRORS, OMISSIONS & ANNOUNCEMENTS

The Auctioneer reserves the right to correct any errors or omissions in descriptions, listings, catalogs, photographs, or announcements at any time prior to or during the auction. Oral announcements made by the Auctioneer shall take precedence over any printed or online materials.

 

NO RELIANCE ON REPRESENTATIONS

Buyers acknowledge that they have not relied upon any oral or written representations, statements, or warranties made by the Auctioneer, consignor, or their agents other than those expressly stated in these Terms & Conditions.

 

CONDITION OF METERS, ATTACHMENTS & ACCESSORIES

Auctioneer makes no representation regarding the condition, completeness, or compatibility of attachments, accessories, implements, or auxiliary equipment included with any item unless expressly stated in the listing.

 

TRANSPORTATION & LOGISTICS DISCLAIMER

Buyers are responsible for determining appropriate transportation requirements, including load securement, permitting, escort vehicles, and compliance with applicable transportation laws. Auctioneer assumes no responsibility for transportation-related compliance or costs.

 

NO GUARANTEE OF MARKET VALUE

Auctioneer makes no representation or warranty regarding the market value, resale value, or future performance of any item sold.

LIENS, LOANS & SECURITY INTERESTS

Sellers represent and warrant that they have the legal right to sell all consigned items and that such items are free and clear of all liens, loans, security interests, and encumbrances unless otherwise disclosed in writing and approved by the Auctioneer prior to the auction.

Disclosure & Payoff Procedure

If an item is subject to a lien or outstanding loan, the seller must disclose the lienholder information and provide a written payoff statement prior to the auction. Any sale of such item is contingent upon the satisfaction and release of the lien.

Handling of Sale Proceeds

When a lien exists, Long Shot Auctioneers may, at its sole discretion, remit sale proceeds directly to the lienholder to satisfy the outstanding balance. Any remaining funds will be released to the seller after the lien has been fully satisfied and proper release documentation has been received.

Buyer Protection

Buyers will receive clear title or ownership documentation only after all liens have been satisfied and released. Long Shot Auctioneers shall not release titled documentation or sale proceeds until lien requirements have been met.

Delays & Limitations

Long Shot Auctioneers shall not be responsible for delays in title transfer or settlement resulting from lien payoff processing, lender requirements, or incomplete documentation provided by the seller.

 

Severability

If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

 

Final Statement

All items are sold AS IS, WHERE IS.
ALL SALES FINAL.

These Terms & Conditions constitute the entire agreement between the parties and supersede all prior representations, statements, or agreements, whether written or oral.
